Approximately two years ago, I was faced with a foreclosure on a small apartment house that I had owned since 1986.  If you all remember 1986, you will remember that this was the height of property values in the Northeast.  The property I owned devalued from approximately $154,000 (my purchase price) to below $50,000 (the auction price).  In the years that I had owned the property, the neighborhood surrounding my house had fallen into decay.  The rents for my property and the surrounding properties had steadily fallen.  Many of the multi-family houses in the neighborhood had been foreclosed upon, and I had progressively lost more and more money year to year on this property.

In 1996, I had finally had enough.  Towards the end of the year, I realized I could not keep the property and stay afloat financially.  I missed multiple payments on my mortgage and tried many times (unsuccessfully) to personally negotiate a settlement with the mortgage holder.  I even offered to refinance the property with them to a lower interest rate if they would agree not to assess the new, greatly diminished property value to the new note.  I would have had to spend approximately $60,000 to refinance the property if the property value was assessed correctly.  In my opinion, this was an example of throwing good money after bad.  They balked on this proposal also; they would only refinance with me if I could come up with the $60,000.  The mortgage holder ended up standing firm on trying to force me to make the original note good again.

It was at this point that I decided I needed to find a lawyer.  After approximately 30 calls to local lawyers and many calls to the various lawyer referral lines, I came up empty.  Every lawyer I talked with said the same thing; "I usually represent the mortgage holder in a case like this."  Being an engineer by trade, I decided to turn to the Internet.  I used the search engines and a few key words to locate a variety of sites.  One site that came up on nearly every search I did was Mory Brenner's.  Not only was he the right kind of lawyer for me (representing my side in the argument), but his site was immediately helpful.  I found the information in it enlightening.  His site gave me a lot of the background knowledge necessary for understanding my situation.

After poring over the data on his site, I decided that Mory was the appropriate lawyer for me.  I hired him the next day and we then worked together on a plan to get me out of the situation with the least possible damage.  Mory was instrumental in advising me on how to protect my current assets (my primary residence) and the investments I had made over the years.  He prepared me for the fight that we knew would come from the creditor.

Although the resolution of the issue took over a year, the final outcome was nothing less than absolutely fantastic.  The property had gone to foreclosure in 1997 and the resultant deficit on the original note was over $80,000.  Had I not had Mory to advise me in this case, I would have been looking at over $80,000 to the creditor.  I could not pay this kind of money out of pocket so I would have had to get another loan to pay off this one.  This kind of financial blemish would have hung over my family's head for many years.

The creditor eventually served us a summons.  It was at that point that Mory started negotiations with the creditor.  His results were superb and immediate.  Within about two weeks of opening negotiations, he had closed on a very acceptable payoff of 11 cents on the dollar for the outstanding balance of the loan.  I was personally mentally prepared to pay much more than that.  Mory clearly went above and beyond the call in this effort.  A contract was drawn up between the creditor and myself and we very recently signed this contract and have closed this very painful chapter in my life.

I credit Mory with coming to a quick and very equitable solution on this problem. His ability to accurately predict every step along the path to closure made me feel very comfortable in an otherwise very stressful time.  His preparation of myself and my financial situation before negotiation also assisted in coming to a favorable resolution.  I would not hesitate to use his services again in a situation like this.
